Meet legal and contractual obligations

3. Third-Party Service Providers
XBorderWeb relies on trusted third-party providers, including but not limited to:

Terms of Service
1. Scope of Services
XBorderWeb provides digital services including:
One-Time Website Packages (Starter, Professional, Premium)
Website Care Plans (monthly subscriptions)
Website Add-Ons (one-time enhancements)
Related consulting and technical services
All services are delivered remotely.
2. One-Time Website Packages
Website packages are billed as one-time payments
Package scope, page count, revisions, and inclusions are fixed as described at purchase
Requests outside the selected package scope may require add-ons or additional invoices
Estimated delivery timelines depend on client responsiveness and asset delivery
Failure to provide required materials may delay the project without penalty to XBorderWeb.
3. Revisions Policy
Revisions are limited to the number specified in the selected package
A revision refers to reasonable changes to existing content or layout
Major changes, new sections, or restructuring are not considered revisions
4. Website Care Plans (Subscriptions)
Care Plans are billed on a monthly recurring basis
Hosting is included while the subscription remains active
Updates are limited by plan type and scope
Unused updates do not roll over to future months
Subscription cancellations take effect at the end of the current billing cycle
XBorderWeb reserves the right to suspend services for unpaid subscriptions.
5. Unlimited Updates Clarification
“Unlimited updates” refers strictly to:
Text changes
Image replacements
Minor content edits within existing pages
The following are excluded:
New page creation
Layout restructuring
Advanced development or integrations
Branding or graphic design
eCommerce catalog management
6. Website Add-Ons
Add-ons are optional and selected during the project or before final delivery
Add-ons are billed separately and included in the final invoice
Work on add-ons begins only after payment is completed
Add-ons are not included in Care Plans unless explicitly stated
7. Client Responsibilities
Clients are responsible for:
Providing accurate, lawful, and complete content
Ensuring they own or have rights to submitted materials
Reviewing deliverables in a timely manner
Maintaining backups of their own data where applicable
XBorderWeb is not responsible for legal compliance of client-provided content.
8. Intellectual Property & Ownership
Ownership of the final website is transferred upon full payment
XBorderWeb retains rights to proprietary processes, templates, and code frameworks
XBorderWeb may display completed projects in its portfolio unless otherwise requested in writing
9. Service Suspension
XBorderWeb reserves the right to suspend or terminate services for:
Non-payment
Abuse of services
Violation of these terms
Unauthorized chargebacks
10. Limitation of Liability
XBorderWeb shall not be liable for:
Indirect or consequential damages
Loss of revenue, data, or business opportunities
Downtime caused by third-party providers
Client misuse or modification of delivered work
Refund & Cancellation Policy
1. One-Time Website Packages
Payments are non-refundable once work has started
Partial refunds may be considered if cancellation occurs before work begins
Completed or partially completed services are not refundable
2. Website Care Plans
Subscriptions may be canceled at any time
No refunds are issued for the current billing period once charged
Service remains active until the end of the billing cycle
3. Website Add-Ons
Add-ons are non-refundable once work has started
Add-ons not yet initiated may be removed from the final invoice if requested in advance
4. Premium Website
Deposits (if applicable) are refundable only if work has not started
Waitlist registration does not guarantee availability or pricing
5. Chargebacks & Payment Disputes
Clients are encouraged to contact XBorderWeb before initiating a chargeback. Unauthorized disputes may result in service suspension and additional administrative fees.
Governing Law
These terms are governed by the laws applicable in the United States, without regard to conflict of law principles.
