  • Technical and usage data related to our website, forms, or service tools.

We do not store or process credit card information on our servers.

2. How We Use Collected Information

Collected information is used to:

  • Deliver and manage website development, maintenance, and add-on services

  • Process billing, subscriptions, invoices, and payments

  • Communicate project updates, requests, and support matters

  • Improve internal workflows, services, and customer experience

  • Meet legal and contractual obligations

We do not sell, trade, or rent your personal information.

3. Third-Party Service Providers

XBorderWeb relies on trusted third-party providers, including but not limited to:

  • Stripe (payments, subscriptions, invoicing)

  • Hosting and domain providers

  • Analytics and tracking platforms

  • Communication, form, and scheduling tools

These providers handle data according to their respective privacy policies. XBorderWeb is not responsible for the privacy practices of third parties.

Clients may request data removal after service termination, subject to legal obligations.

Terms of Service

XBorderWeb provides custom website design, development, and hosting services for service-based businesses.

By purchasing any service from XBorderWeb, the client agrees to the policies outlined below as well as the Website Design & Hosting Agreement referenced during the purchase process.

Service-specific terms may be outlined in separate agreements referenced during the purchase process, including the Website Design & Hosting Agreement.

Subscription services such as Website Care Plans are governed by the active subscription agreement associated with the client account.

1. Website Projects

All website design projects require a project deposit in order to begin development.
The deposit secures the client’s place in the project schedule and allows work on the website design and development to begin.
The remaining project balance must be paid prior to the website going live.

Full project details, including scope of work, timelines, and responsibilities, are outlined in the Website Design & Hosting Agreement, which clients must review and accept before submitting payment.

2. Project Scope

Website projects are completed according to the package selected by the client at the time of purchase.

Packages may include:

• Starter Website
• Professional Website
Premium Website

Each package includes a predefined number of pages, features, and revision rounds. Any requests beyond the scope of the selected package may require additional fees and may extend project timelines.

3. Hosting & Maintenance

All website projects include hosting for the first 12 months after the website is launched.

This hosting includes:

• Secure website hosting
• SSL certificate
• Server monitoring
• Basic security updates
• Website backups
• Performance monitoring

4. Annual Hosting Renewal

After the first year, an annual hosting & maintenance renewal is required to keep the website online.

Current renewal fee:

$249 per year

This renewal covers continued hosting infrastructure, server maintenance, backups, and security monitoring. If the annual hosting renewal is not paid, XBorderWeb reserves the right to suspend or remove the website from its hosting infrastructure until the renewal payment has been completed.

Clients subscribed to an active Website Care Plan may receive discounted hosting renewal pricing depending on the selected plan.

5. Client Responsibilities

Clients are responsible for providing all necessary materials required to build the website, including but not limited to:

• Business information
• Service descriptions
• Photos or branding materials
• Contact information
• Logos or graphics

Project timelines begin once all required materials have been received. If the client does not provide the required materials within a reasonable timeframe, the project may be paused until all necessary information is received.

Delays in providing project materials may result in delays in project completion.

Clients purchasing website services must review and agree to the XBorderWeb Website Design & Hosting Agreement before work begins.

6. Project Timelines

Once all project information has been received, XBorderWeb typically delivers an initial website preview within 3–5 business days. Clients may request revisions according to the number of revision rounds included in their selected package.

Project timelines depend on client responsiveness. If the client becomes unresponsive for more than 30 days during the project, the project may be paused and may require rescheduling before work resumes.

7. Ownership

Full ownership of the website transfers to the client only after all outstanding balances owed to XBorderWeb have been paid in full.

Outstanding balances may include, but are not limited to:

• remaining project balances
• unpaid hosting or renewal fees
• unpaid subscription commitments such as Website Care Plans
• additional services requested by the client

XBorderWeb reserves the right to withhold website files, restrict administrative access, or suspend website services until all outstanding balances have been paid in full. Website files are delivered in the format used by the platform on which the website was built. XBorderWeb is not required to provide editable source files, development files, or platform exports outside of the platform used to build the website.

8. Limitation of Liability

XBorderWeb is not responsible for business losses, lost revenue, or damages resulting from website downtime, hosting interruptions, or third-party service failures.

While we take reasonable steps to maintain website stability and security, no hosting infrastructure can guarantee uninterrupted service.

9. Payment Disputes

By submitting payment for any service, the client confirms that they have reviewed and agreed to the applicable service agreement and policies. Clients agree to contact XBorderWeb directly to resolve any billing concerns before initiating a chargeback or payment dispute.

Submitting a chargeback for services already delivered may be considered a violation of this agreement and may result in service suspension or legal recovery efforts.

Refund & Cancellation Policy

Because website design involves custom work and project planning, refunds are limited.

1. Project Deposits

Website projects require a $399 project deposit to begin development. This deposit secures the client’s project slot and covers initial planning, design preparation, and development work. The project deposit is applied toward the total cost of the selected website package.

Deposits are non-refundable once work on the project has begun.

2. Project Cancellation

If a client cancels the project before development has started, a refund may be issued at the discretion of XBorderWeb.

3. Completed Work

Once a website has been designed, delivered, or launched, the project is considered non-refundable. Clients remain responsible for any remaining project balance prior to the website going live.

Website Care Plans & Subscriptions

XBorderWeb offers optional Website Care Plans for clients who want ongoing website updates and support. These plans provide continuous monitoring, updates, and performance improvements for active websites.

Care Plan Services

Depending on the selected plan, services may include:

• Content updates
• Performance monitoring
• Security checks
• Basic SEO adjustments
• Analytics review
• Technical support
• Image optimization
• Website backups

Care plan details vary depending on the selected plan tier.

Hosting Renewal Discounts

Clients subscribed to an active Website Care Plan may receive discounted hosting renewal pricing depending on the selected plan tier. Some plans may include the annual hosting renewal while the subscription remains active.

Basic Care Plan – 20% off annual hosting renewal

Business Care Plan – 50% off annual hosting renewal

Unlimited Care Plan – annual hosting renewal included while the plan remains active.

Hosting renewal discounts or included renewals apply only while the Care Plan subscription remains active. Discounts do not apply retroactively and do not continue after the subscription has been cancelled.

Optional Service

Website Care Plans are optional subscription services that provide ongoing website maintenance, updates, and support. Care Plans require a minimum 12-month commitment. After the initial term, subscriptions continue on a month-to-month basis unless cancelled. Hosting renewal discounts apply only while the Care Plan subscription remains active.

Billing

Care Plans are billed on a monthly recurring subscription basis.

If a client cancels a Care Plan before completing the minimum commitment period, the remaining balance of the minimum term may become due. Hosting renewal discounts or included renewals apply only while the Care Plan subscription remains active.
